software update you acknowledge and agree to the following:

#1 - I understand that by FAA Regulation this software update is considered a "Minor Alteration" which must be signed off by an appropriately-rated Repair Station, A&P, or IA.

#2 - I understand that Avidyne has made this software available for download, but this action does not relieve me of responsibility of following the FAA Regulations as they pertain to this aircraft.

#3 - I understand that should I choose to have this update performed by anyone other than an Avidyne Authorized Dealer, and should something go wrong during the update, the unit may have to be returned to Avidyne for repair at the current out of warranty repair cost plus dealer fees. I further understand that this repair will not be covered under Avidyne Warranty, nor will any labor charges that may be associated with said repair. I also understand that, to the extent this situation is applicable, Avidyne does not carry an exchange pool to support this type of repair, therefore my IFD will be eligible for Repair and Return ONLY, which may incur up to a 10-15 day turnaround time.

#4 - If I choose to forward the software to someone else, after obtaining it from Avidyne, I am personally assuming responsibility of ensuring whomever I may forward the software to understands and agrees to all of the above.
